Updated: Oakland Hills Hostage Situation

A SWAT team was called to Aspinwall Road Wednesday evening

Bay City News—A hostage situation stemming from the violation of a restraining order in the Oakland Hills on Wednesday ended when police took the suspect into custody, police said.

Police responded to a report that a person had violated a restraining order at a home in the 6400 block of Aspinwall Road at 6:40 p.m.

The situation quickly turned into a hostage situation with the suspect barricaded inside the home, police said. A SWAT team was called in to assist in getting the suspect out of the home.

However, shortly after that the suspect was taken into custody peacefully, police said.

The Oakland Police Department released more details about the incident late Thursday morning. Their statement says:

"Last evening, May 9th, 2012, at about 6:40 p.m., Oakland police officers were dispatched to a home within the 6400 block of Aspinwall Road to ensure the well-being of a female resident. A third party caller had reported to police that the woman possessed a restraining order against a man, Michael Dias (10-12-56). The caller reported a history of domestic violence, that Dias had been recently released from jail, Dias’ potential access to weapons, and that he had been seen recently near the area.

"When officers arrived, they heard a woman’s voice from inside the residence; however, the woman became silent and did not answer when officers knocked to check on her safety. Shortly after, officers were able to establish that a man matching Dias’ description was inside the residence, and refused to communicate with police.

"Numerous attempts to establish contact with occupants were unsuccessful. Due to the potential of an armed and barricaded suspect, as well as the presence of a potential hostage, the Alameda County SWAT unit was called to the scene in order to make the safest and most effective entry possible into the home. The Oakland Police entry team was unavailable due to an unrelated, but contemporaneous, incident.

"At approximately 1:00 a.m., Alameda County Sheriffs Deputies made entry and safely apprehended Dias while finding the female inside and unharmed.

"Investigators believe that Dias made unlawful entry into the home, without the woman’s permission, and refused to leave or allow the woman to freely go. Dias was arrested by Oakland police for violation of a restraining order and false imprisonment.

"The investigation is on-going as Dias remains in custody this morning."
