"The Board approved the replacement as part of the priority funding for the Seismic Safety Bond Program on May 23, 2012 upon verification that the District had received sufficient funding from the State to complete the Beach seismic project. Replacement of the HVAC units on the various campuses was postponed until verification that the District had sufficient funds to proceed. The units were identified to be in significant disrepair as to not warrant waiting until summer of 2013 to protect student health and safety. The nature of the project is such that it must be done when students are not on campus. The District Construction Manager, Vila Construction, received three bids from local companies and Sullivan presented the lowest responsible bid and commitment to meet the timeline to finish before the start of the 2012-13 school year."

To award the contract in the absence of formal bidding, the board must make a finding of "futility of public bidding." The board agenda and the "futility resolution," which includes details about the lack of formal bidding, are attached above as PDFs.
